1. Acceptance of Terms

By accessing or using LuvPlant's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

LuvPlant provides an AI-powered plant care companion service. Each plant you add can be assigned a unique personality and communicates with you through in-app chat and SMS reminders. The AI chat feature is powered by Claude (Anthropic) and is designed exclusively to provide plant care guidance — it is not a general-purpose AI assistant or a substitute for professional horticultural or medical advice.

3. Age Requirements

LuvPlant is strictly intended for users who are 18 years of age or older. By creating an account or using LuvPlant, you represent and warrant that you are at least 18 years of age.

• If you are under 18, you may not create an account or use LuvPlant.
• If we discover that a user is under 18, we will promptly delete their account and all associated data.

If you believe an individual under 18 has created an account, please contact us immediately at privacy@luvplant.app so we can delete their data.

4. Account Registration

To use LuvPlant, you must:

• Meet the age requirements described in Section 3
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

5. AI-Powered Features

LuvPlant's chat feature uses artificial intelligence (Claude by Anthropic) to generate responses in the voice of your plant's personality. By using this feature, you acknowledge that:

• Responses are AI-generated and may occasionally be inaccurate
• The AI is designed to provide plant care guidance only — it is not a therapist, counselor, or general-purpose assistant
• AI responses should not replace professional horticultural advice for high-value or sensitive plants
• Your chat messages are stored in our database to maintain conversation history (see our Privacy Policy)
• Message content is processed by Anthropic in accordance with their usage policies

We do not claim perpetual or irrevocable rights to your chat content. Your conversations belong to you and are deleted when you delete your account.

6. Subscription and Billing

LuvPlant offers the following plans:

• Free Plan: Up to 2 plants, core features
• Plant Parent: Up to 10 plants, full features including SMS reminders
• Whisperer: Unlimited plants, all premium features

Subscriptions automatically renew unless cancelled. You may cancel at any time through your account settings.

7. SMS Terms

By providing your phone number, you consent to receive automated SMS messages from LuvPlant regarding plant care reminders. Message frequency varies based on your plants' care schedules. Standard message and data rates may apply. Reply STOP to opt out at any time, or update your preferences in Settings. SMS reminders require an eligible paid subscription.

8. Data Retention and Deletion

You own your data. When you delete your LuvPlant account:

• All plant data, care logs, and chat messages are permanently deleted within 30 days
• We do not retain, sell, or transfer your personal data or chat content after deletion
• Anonymized, aggregated usage statistics that cannot identify you may be retained for product improvement

9. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Attempt to manipulate the AI chat for purposes outside plant care
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Create multiple accounts for abusive purposes
• Share your account credentials with others

10. Intellectual Property

The LuvPlant service, including all content, features, and functionality, is owned by LuvPlant and protected by intellectual property laws. You may not copy, modify, or distribute any part of our service without permission. Your personal data and chat content remain yours.

11. Disclaimer of Warranties

LuvPlant is provided "as is" without warranties of any kind. While we strive to provide accurate plant care advice through our AI features, we are not responsible for plant health outcomes. Always consult professional resources for specific or high-stakes plant care needs.

12. Limitation of Liability

LuvPlant shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to damage to or death of plants.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.
